1. Who we are

iplay.free is operated by Const Agility, LLC, 17350 State Hwy 249, Ste 220, Houston, TX 77064, USA. You can reach us at team@constagility.com. By using iplay.freeyou agree to these terms. If you don’t agree with them, please don’t use the site.

2. Using the games

You may play every game on iplay.freefor free, as often as you like, for personal, family or classroom use. You don’t need an account and we won’t ask you to pay for anything. Teachers and parents are welcome to use the games with a class or a child at home.

3. What we ask you not to do

Please don’t:

• try to break, overload, or interfere with the site or the servers behind it, or get around any limit we put in place;
• send automated or artificial traffic to the site, including anything intended to distort the public play and like counts;
• copy the site’s content or code to republish it as your own, or resell access to the games;
• use iplay.free for anything unlawful, or in a way that harms other players.

If someone does any of the above, we may block their access without notice. Given the site has no accounts, that generally means blocking traffic rather than a person.

4. Who owns what

The design, text, artwork and code of iplay.free, and the games we wrote, belong to Const Agility, LLC. You may link to any page freely, and you may quote short passages with attribution. You may not copy the games or the site wholesale.

Many of the games are our own versions of classics that have been played for generations — sudoku, solitaire, mahjong, minesweeper, nonogram, memory and word puzzles among them. Those underlying game concepts are not owned by anyone, and our implementations were written by us.

5. We are not affiliated with other games

Where a page mentions another game or product by name, it is to describe what one of our games is like, or to help people find us when they search for that kind of puzzle. Those names belong to their owners. iplay.free is not affiliated with, endorsed by, or sponsored by any of them.

6. The games are provided as they are

We build these games carefully and we want them to work well, but we provide iplay.free“as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don’t promise that the site will always be available, that every game will be free of bugs, or that saved progress will never be lost. Progress is stored in your own browser, so clearing your browser data will clear it.

Some places don’t allow certain warranties to be excluded, so parts of this section may not apply to you.

7. Limits on our liability

To the fullest extent the law allows, Const Agility, LLC will not be liable for any indirect, incidental, special or consequential damages arising from your use of iplay.free, including lost data or lost game progress. Because the site is provided free of charge, our total liability to you for any claim relating to iplay.free is limited to one hundred US dollars (US$100).

8. Children, parents and teachers

iplay.free is made to be safe for children: there are no accounts, no chat, no user-generated content, no advertising, and no purchases. We do not knowingly collect personal information from anyone, including children. What we do count, and what stays on your device, is set out in our Privacy Policy. If you are a parent or teacher and something concerns you, please write to us at team@constagility.com and we will respond.

9. Links to other sites

Some pages link to sites we don’t run — for example our own social profiles. We aren’t responsible for their content or their privacy practices, and these terms don’t apply to them.

10. Changes

We add and improve games regularly, and we may change or retire one at any time. We may also update these terms; when we do, we’ll change the date at the top of this page. If a change is significant, we’ll say so on the site. Continuing to use iplay.free after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, and any dispute relating to iplay.free will be brought in the state or federal courts located in Texas. If you are using iplay.free from somewhere else, you may also have rights under your own local law that these terms cannot take away.

A note on language: iplay.free is available in twelve languages, but this document is published in English only. We would rather give you one version we can stand behind than eleven translations of a legal text that no lawyer has checked.
